Community Care and Mental Health

What Our Barristers Do

Our community care and mental health barristers have specialist expertise in community care and adult social care law, including community care provision for adults, Children Act challenges, mental health and mental capacity.

This includes challenges to failure to assess under the National Health Service and Community Care Act 1990 and failure to provide under the National Assistance Act 1948.

Other cases in which we act and advise include mental health and mental capacity/Court of Protection cases, cases involving asylum seekers and immigration control, care home funding disputes, and cases relating to charging for residential accommodation and the Charging for Residential Accommodation Guide (CRAG) rules.

Who Our Barristers Act For

Our clients include local authorities, health authorities, individuals, families and the Official Solicitor.

Where Our Barristers Act

Our barristers advise on and appear in judicial review challenges in the Administrative Court and subsequent hearings in the Court of Appeal and Supreme Court, as well as in the Court of Protection.
